If there was no witness, the family has no way of knowing that. If there was a security camera somewhere recording the accident, I guess that would have counted as a witness.

I don'tknow what kind of switch the motorcycle headlight has, but I think the setting would have remained the same after the accident to verify the claim of not being in use. But the cycle's rider should have seen the headlight of the car befor entering the intersection.

Some newer cars have their version of "black boxes" to download recent speeds and driving habits (seatbelt buckled). A New Jersey Governor recently was injured in a crash and it was found that his driver was going faster than was claimed. Maybe either vehicle in this quiz had such a thing.

Have the pieces of glass from the windshield or lights been examined for their refractivity ? Also, look for any paint chips that might have been caused by impact.
Another possibility are the Forensic Aspects of Driver Reaction and Response

    Couple of quick comments..

    1) There is no question if the motorcycle hit the vehicle or not. So the paint chips aren't going to tell you much.

    2) To the comment from DYnamo1 regarding the family not knowing about the car pulling out - this is exactly what happened. The car tried to merge onto the road that the motorcycle was already traveling down. Sorry if I didn't explain that well enough in the scenario.

    3) To the couple of posts about looking at items. You're on the right path. The answer lies in the forensic evidence left behind, so we don't need an eyewitness...

Hey I just found this thread, sounds cool.

I'd like to give it a shot. How about looking at skid marks on the road?

Have you made a spectrographic analysis of the soil? Check for any small pieces pieces of cloth . Also check the roadway for any presence of blood , tissue and and hair.
Also , if there is any broken equipment, photograph it so a proper identification can be made.

What about pieces of glass from the motorcycle headlamp? Perhaps they could tell if the motorcycle headlights were turned on?
Or scratch marks or patterns on the side of the car?

Have there been any tests on either driver for alcohol or drugs or has too much time elapsed? They may play a factor.

Test the blood alcohol level and stomach contents of the motorcyclist, and blood alcohol of the driver.

Toxicology results showed neither the cyclist or the car driver were under the influence of any impairing substance.

There is plenty of clothing, blood, tissue, and hair rubbed into the road from where the cyclist slid down the road.

The whole crime scene was properly documented.

The next step , if possible, would be a thorough examination of the victim(s him/themselves for any evidence , with the doctor's permission. However, should that not be in the offing, the next step would most undoubtedly be to examine the vehicle itself.

Since the cycle hit the door and not the front bumper, that might mean the car had the right of way because it was already into the intersection. There were no skid marks to show the cycle trying to brake at the last moment.

Has the undercarriage of the cycle/car been checked for evidence? And has the temperature of the radiator been taken?
