The week of January 28 found the franchise coming up short.
On Monday, CSI: Miami was not shown because CBS aired the State of the Union address.
CSI: New York aired a repeat on Wednesday and came in third (with 7.10 million viewers at 10:00pm and 7.44 million at the half-hour) against a new episode of Law and Order (11.19 million, 11.05 million at 10:30pm) and a two-hour repeat of Lost (8.47 million at 10:00pm, 8.53 million at the half-hour). In the crucial 18-49 demographic, Lost (3.4 rating/9 share) came in first with Law (3.2/8, 3.1/9 at the half-hour) and CSI:NY (1.9/5 at 10:00pm and moving up to 2.0/6 at 10:30pm) pulling in behind.
A repeat episode of CSI: New York was aired on Thursday before the repeat of CSI: Crime Scene Investigation. In this special time slot, New York did better than in its usual timeslot the night before (8.33 million viewers at 8:00pm and 9.31 million at the half-hour). CSI went up against the season four premiere of Lost at 9:00pm and came up short. CSI pulled in 11.82 million viewers at 9:00pm and went up to 11.93 million at the half-hour, compared to Lost's 15.95 million and 16.19 million, respectively. In the 18-49 demographic, Lost (6.6/16, 6.8/17 at the half-hour) easily beat CSI (2.7/7, 2.8/7 at 9:30pm), which came in a tie for second place with Celebrity Apprentice.

The CSI franchise scored one victory during the week of February 4.
On Monday at 10:00pm, CSI: Miami's repeat came in a distant third with 8.71 million viewers (moving to 8.83 million at the half-hour) compared to ABC's 20/20 (13.84 million, 13.03 million at 10:30pm) and NBC's Deal or No Deal (13.07 million, 14.47 million at the half-hour). In the 18-49 demographic, Miami was also third-best with 2.4 rating/6 share (2.5/7 at 10:30pm), coming in behind 20/20 (4.7/12, 4.5/12) and Deal (4.4/11, 5.1/14).
The final new episode of CSI: New York penned before the writer's strike began (and the final new episode for the franchise until the strike is over) aired on Wednesday and won its timeslot with 10.73 million viewers and a score of 3.2/9 in the 18-49 demographic. The series would have benefited from a new lead-in episode of Criminal Minds. Law and Order came in second with 10.07 million viewers and 2.9/8 in 18-49.
A new episode of Lost beat a repeat of CSI: Crime Scene Investigation for the second week in a row with 15.06 million viewers compared to CSI's 11.91 million, and Celebrity Apprentice followed in third place with 8.66 million. While CSI came in second in overall viewers, it flip-flopped with Apprentice in the 18-49 demographic. Lost led that category as well with 6.4/16, Apprentice regained its supremacy over CSI with 3.3/8, and CSI came in third with 3.2/8.
